Nusantarakini.com, Jakarta –The chairman of the Lindeteves HWI Market Cooperative, Chandra Suwono, believes that the California-based company, WD-40, has violated Indonesian law and order. This is related to the dispute between WD-40 and one of the local entrepreneurs of Get All-40, Benni Bong who is a member of the cooperative he leads.
Several issues have been highlighted by the Chairman of the HWI Market Cooperative, Lindeteves. The first is that the claim for compensation by Get All-40 against WD-40 which was filed on August 10, 2020, and was only heard on January 6, 2021, was not responded to by WD-40, because it was not present at the first hearing. But a few days later they filed a counterclaim against Get All-40 with a lawsuit to cancel the Get All-40 certificate that had been issued since 2008 and 2019 by HKI.
“As a result of the lawsuit there was legal confusion in Indonesia and violated legal propriety which was based on cheap, fast and simple until it became protracted,” explained Chandra to the media crew in Jakarta, Friday (4/6/2021).
What’s more, continued Chandra, the lawsuit against WD-40 is a civil case which refers to Law No. 20 of 2016 on a special civil brand. That the examination hearing until the decision on the lawsuit as referred to in paragraph 1 must be completed within 90 days after the case is received by the panel that examines the case. And can be extended for a maximum of 30 days with the approval of the Chief Justice of the Supreme Court (MA).
“It has become protracted because so far it has exceeded 4 months and 120 days, the case has not yet been decided and the trial is still ongoing. Besides that, the claim for compensation from Get All-40 is still ongoing, although there is overlap, as a result of one subject there are two lawsuits with the same parties,” explained Chandra.
Chandra Suwono hopes that this case can be decided as soon as possible to provide legal certainty in the business world. And the provisional lawsuit filed by Get All-40 for the temporary suspension of the sale of WD-40 and Get All-40 can be granted by the panel of judges for the sake of justice for both parties in preventing the losses from getting bigger.
“The Chairman of the HWI Market Cooperative, Lindeteves hopes that this case can be resolved through mediation and find a solution so that it does not drag on and can provide certainty in the business world,” concluded Chandra. [se]
